This Privacy Statement describes how AquaGas Pty Ltd manages personal information and respect your privacy. This policy may be amended from time to time. We encourage visitors and users of our website to regularly review our Privacy Policy.

All “Personal Information” (which is defined as any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains) that we collect and maintain will be subject to this Privacy Policy, as amended from time to time.

When we refer to “AquaGas Pty Ltd”, we mean the AquaGas Pty Ltd entity that acts as the controller or processor of your information, as explained in more detail in the section below.

AquaGas Pty Ltd is committed to subjecting all personal data received from European Union (EU) member countries and Switzerland, respectively, in reliance on the GDPR, to the Framework’s applicable Principles. The legal basis for processing your personal data is:

  • 6 Sect 1, lit. b GDPR (for pre-contractual measures or execution of a contract),
  • 6, Sect. 1, lit. f GDPR (justified interest of the person/entity responsible)

AquaGas Pty Ltd is responsible for the processing of personal data it receives, under the GDPR, and subsequently transfers to a third party acting as an agent on its behalf. AquaGas Pty Ltd complies with the GDPR principles for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions.

With respect to personal data received or transferred pursuant to the GDPR, AquaGas Pty Ltd is subject to the regulatory enforcement powers of the European Trade Commission. In certain situations, AquaGas Pty Ltd may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. Entities Collecting Personal Information

 This privacy notice is issued on behalf of AquaGas Pty Ltd so when we mention “AquaGas Pty Ltd” or “AquaGas Monitoring Systems”, “we”, “us” or “our” in this privacy notice, we are referring to AquaGas Pty Ltd responsible for processing your data.

Collection of Personal Information

 As a visitor to AquaGas Pty Ltd website, you can engage in many activities without providing any personal Information.

However, when you order products or services from AquaGas Pty Ltd, in order to provide the services to you, we may collect the following Personal Information from you:

  • Contact information such as your name, phone and fax numbers, company address and company email address.
  • Invoicing information such as the order number, references, order and shipment dates.
  • Demographic information such as your job title, job description and company name and company type.

Processing your personal data on the basis of justified interests

You have the right to access and correct or delete your personal Information and privacy preferences at any time. For security purposes, certain personal Information can only be changed by contacting support. We will respond to your request promptly within a reasonable timeframe. Depending upon the activity, some of the information that we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity.

Pursuant to Art. 7, Sect. 3 GDPR, you are entitled to withdraw your granted consent from us at any time, resulting in the fact that we may not continue the processing of data based on your consent for the future.  The legality of the processing performed on the basis of the consent until withdrawal will not be affected by the withdrawal.

Pursuant to Art. 15, GDPR, you are entitled to request information on your personal data processed by us. In particular, you may request information on the purposes of processing, the category of your processed personal data, the category of recipients to whom your data is or will be disclosed, the planned storage time, availability of rights to correction, deletion, restriction of processing or an objection, availability of the right to complain to a supervisory authority, origin of the data unless they were collected by us, as well as the existence of automatic decision making including profiling and, if applicable, significant information on their details.

Pursuant to Art. 1 6 GDPR, you are entitled to request the correction of incorrect personal data or the completion of personal data stored with us.

Pursuant to Art. 17 GDPR, you are entitled to request the deletion of your personal data stored with us unless there is a legal basis which entitles or obliges us to store the data.

Pursuant to Art. 18, GDPR, you are entitled to a limitation of the processing of your personal data, if:

  • you contest the correctness of the processed personal data for a period which allows us to verify the correctness of the personal data;
  • the processing is illegal and you request a deletion of the personal data and a limitation of the use of the personal data instead;
  • we no longer need the personal data for processing but you need it for a asserting, exercising or defending legal claims; and
  • you object to the processing pursuant to Art. 21, Sect. 1 GDPR as long as it is not certain whether or not our justified reasons outweigh your reasons.

Pursuant to Art. 20 GDPR, you are entitled to request your personal data you provided to receive it in a structured and machine-readable format or the transmission to another person/entity responsible.

Pursuant to Art. 77 GDPR, you are entitled to a complaint to a supervisory authority if you think that the processing of your personal data violates the GDPR.

Right to object

As far as your personal data is processed on the basis of justified interests pursuant to Art. 6, Sect. 1, lit f GDPR, you are entitled to lodge an objection to the processing of your personal data pursuant to Art. 21 GDPR if there are reasons which result from your particular situation.

Providing your data

The provision of certain personal data is required for rendering our services in the area of data protection consulting or the activity as a data protection officer for our customers. If this data cannot be provided, we cannot render these services in certain cases. Normally, it is not necessary for a supplier to provide personal data for us

How Your Personal Information Is Used

As is true of most websites, when you use the AquaGas website, AquaGas Pty Ltd or third-party sub processors contracted by AquaGas Pty Ltd may also collect certain technical and routing information about your computer to facilitate your use of the Site and its services. For example, we may log environmental variables, such as browser type, operating system, CPU speed, and the Internet Protocol (IP) address of your computer. We use these environmental variables to facilitate and track your use of the website and its services. AquaGas Pty Ltd also uses such environmental variables to measure traffic patterns on the Site. To better understand the needs of our visitors to the website we may occasionally match such information with your Personal Information.

Recipients of your personal data

Your personal data will only be disclosed to external contractors who perform for us certain activities within the scope of order processing pursuant to Art. 28, GDPR. The contractors employed are:

  • Verdikt: Web Agency
  • Constant Contact: Email marketing
  • Cooper: Customer Relation Management
  • AquaGas suppliers and Partners
  • Parcel service provider; and
  • Payment processors.

In addition, we will also disclose your data to external offices if we are obliged to do so for legal reasons.

Time of storage

Personal data stored on the basis of legal safekeeping obligations will be deleted as soon there is no longer an obligation for safekeeping. Otherwise, personal data will be deleted if the purpose of processing is no longer applicable. Data which we store on the basis of a granted consent of the person affected pursuant to Art. 6, Sect. 1, lit.a GDPR will be deleted whenever the purpose of processing is no longer applicable or the consent is withdrawn.

Information Sharing with Service Providers/Agents

We have appointed a data protection assistant for AquaGas Pty Ltd who is responsible for overseeing questions in relation to this privacy notice.
